By accessing or using the NYTELIFE platform, website (nytelife.be), mobile application, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
The Service is operated by LYTE Studios (“we”, “us”, or “our”), a company registered in Belgium. These Terms constitute a legally binding agreement between you and LYTE Studios.
You must be at least 18 years old to create an account or use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
NYTELIFE provides a cashless payment and ordering platform for live events. The Service enables:
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We are not liable for any loss arising from unauthorized access to your account where you have failed to safeguard your credentials.
We reserve the right to suspend or terminate accounts that we reasonably believe are in violation of these Terms, are being used fraudulently, or pose a risk to the integrity of the Service.
All payments are processed through certified third-party payment processors (including Stripe). We do not store your full payment card details on our servers.
Wallet top-ups are processed in real time. Funds loaded into your NYTELIFE wallet are held for the purpose of making purchases at participating events.
Unspent balance: Any remaining wallet balance after an event ends will be automatically refunded to the original payment method. Refund processing times depend on your bank or payment provider and are outside our control.
Order refunds: Individual order refunds are at the sole discretion of the event organizer. We facilitate the refund process but are not responsible for refund decisions made by organizers.
All prices displayed on the platform are set by the event organizer. We are not responsible for the pricing, quality, or availability of items offered at events.
Event organizers using the Service are solely responsible for:
LYTE Studios acts solely as a technology provider and payment facilitator. We are not a party to the transaction between organizers and attendees.

All content, trademarks, logos, software, and design elements of the Service are the exclusive property of LYTE Studios or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We make no guarantees regarding the reliability of any information obtained through the Service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LYTE STUDIOS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
Our total aggregate liability for all claims arising from or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.
We are not liable for any losses caused by event organizers, including but not limited to unfulfilled orders, incorrect items, or event cancellations.
You agree to indemnify, defend, and hold harmless LYTE Studios and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
The Service may integrate with or rely on third-party services (including payment processors, hosting providers, and analytics tools). We are not responsible for the availability, accuracy, or practices of these third parties. Your use of third-party services is subject to their respective terms and policies.
We may terminate or suspend your access to the Service at any time, for any reason, including violation of these Terms, without prior notice or liability. Upon termination, your right to use the Service ceases immediately. Any wallet balance at the time of termination will be refunded in accordance with Section 5, unless the termination is due to fraudulent activity, in which case we reserve the right to withhold funds pending investigation.
We reserve the right to modify these Terms at any time. Material changes will be communicated via the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
These Terms are governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Belgium.
If you are a consumer residing in the European Union, you retain any mandatory consumer protection rights under the laws of your country of residence that cannot be waived by contract.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and LYTE Studios regarding the Service and supersede all prior agreements, understandings, and communications.
